Two charged with forging land ownership documents for Muthera farm

Two people have been charged before a Nakuru court in connection with forging land ownership documents relating to Muthera farm.
Josephat Ole Mpoe and Joseph Ole Mpoe were charged with 10 charges ranging from, conspiracy to commit a felony, giving false information, making a document without authority and false swearing.
According to court documents, the accused persons on April 11, 2023 conspired together to commit a felony namely making a title deed without authority.
“The title deed in the name Kikenyi Ole Mpoe, was made with the intent to defraud the administrators of the estate of the late Mbiyu Koinange on a parcel of land situated in Mau Narok in Nakuru County, approximately 4,296 acres worth Sh 5 billion,” read part of the court documents.
Additionally, the two suspects are alleged to have given false testimony to the police in Njoro that led the police to investigate the matter.
“You stated that the parcel of land situated in Mau Narok in Nakuru County, approximately 4,296 acres worth Sh 5 billion, belongs to the Late Kikenyi Ole Mpoe, information that you both knew to be false, intending the police to use his lawful investigation power to investigate and recommend arrest of the administrators of the estate of the Late Mbiyu Koinange,” read the document in part.
Also, the two-stand accused of making a memorandum of registration of transfer of land in the name of Kikenyi Ole Mpoe, purporting it to be a memorandum of registration of transfer of land properly processed and issued by the Ministry of Lands.
The two pleaded not guilty to all the charges.
Through their lawyer they requested for favourable bail and bond terms.
The court granted each a bond of Sh 2 million or an alternative cash bail of Sh 1 million.
The land has been a subject of a bitter dispute between the late minister’s family and members of the Maasai community who claim the land is their ancestral land and accused some powerful individuals within President Jomo Kenyatta's administration of grabbing it.
