Milimani estate residents sue county and Jade Hekima bar over noise pollution

The Nakuru Milimani Residents Association has taken legal action against the Nakuru County Government and Jade Hekima Lawn, an entertainment venue in their area, for noise pollution and public nuisance.

In their petition to the Environment and Lands Court, the Association argues that they have enjoyed serene and peaceful surroundings for decades until Jade Hekima set up an entertainment and alcohol sales establishment in the residential area.

"The Nakuru County Government unprocedurally issued a trade permit to Jade Hekima to operate a mega bar without conducting any public participation amongst neighbouring residents, as is legally required," the document states. 

The petition states that Jade Hekima plays loud music throughout the night and into the early morning, violating the residents' right to property and to live in a clean, healthy, pollution-free environment.

"Jade Hekima is situated near learning institutions such as the Kenya Medical Training College, the Nakuru Level 5 Hospital, and the Nakuru Cancer Hospice, and their loud music affects patients in these institutions," the document further states.

The petitioners argue that the establishment has become a nuisance to the residents and is having a negative influence on their children, who are exposed to obscene language and indecent behaviour portrayed by the patrons and revellers of this establishment.

The Association wants the court to cancel the trade permit issued to Jade Hekima by the Nakuru County Government.

Additionally, they want the court to bar the Nakuru County Government from renewing or reissuing any such permits without public participation, and to restrain Jade Hekima from continuing to operate a business in the area.

The matter will be mentioned on January 27, 2026 for further directions.
