Dr Magare files petition in court challenging President Ruto's appointment of Muriithi, Gitura and Wa Iria

Dr Benjamin Magare has moved to court to challenge the appointment of former governors and politicians to state corporations.

The Nakuru-based doctor, who is also a Consulting General Surgeon at Nakuru Level Five Hospital, says his decision to file the petition was prompted by President William Ruto's decision to appoint former Laikipia Governor Nderitu Muriithi, former Deputy Senate Speaker Kembi Gitura and former Murang'a Governor Mwangi wa Iria as non-executive chairpersons of the Kenya Revenue Authority (KRA), Kenyatta University Teaching Referral and Research Hospital and the Public Regulatory Board respectively.

"The appointment of these individuals does not comply with Article 232 of the Constitution of Kenya. Which clearly states that appointments must be based on merit and there must be clear guidelines that should be followed such as advertising the positions, should have been followed but these said guidelines were circumvented," he says.

Dr Magare says in an affidavit that these appointments were made on political favouritism.

The matter was brought before the Milimani Commercial Court of the Employment and Labour Relations Court on January 6 before Judge Jemimah Keli.

"The application will be served within one day and a response will be given within 7 days," reads part of the court papers.

The matter will be heard on 16 January.

This is not the first time Dr Magare has gone to court over governance and accountability issues.

Dr Magare went to court to try and compel former President Uhuru Kenyatta to appoint judges nominated by the Judicial Service Commission (JSC).

He also went to court to challenge Governor Susan Kihika's appointment of members of the Nakuru County Executive Committee.
