Court postpones judgement of case seeking to declare Susan Kihika unfit to hold public office

The court has postponed the delivery of the judgement on a case seeking to declare Nakuru governor Susan Kihika unfit to hold public office.

The case which was slated for judgement on Wednesday was pushed to April 13 after the court said judgement was not ready and the judge needed more time to conclude writing it.

The case was filed by the Law Society of Kenya (LSK) on April 15, 2024, who sought to have governor Kihika removed from office after accusing her of public misconduct and violation of human rights.

The allegations stemmed from the controversial takeover of the Nakuru War Mermorial Hospital which the LSK said violated the rights and dignity of patients. 

The petitioners argued that the Nakuru County government raided and took over the management of the Nakuru War Memorial Hospital in 2023, using "hired goons." 

The law body argued that the takeover was unconstitutional and they further state that the Governor illegally seized the hospital in October 2023 and disregarded court orders.

The LSK sued Governor Kihika, Nakuru County Government, the National Lands Commission and the Attorney General.

The case has been ongoing for the last two years and in 2025 Ms kihika made unsuccessful attempts to have the case struck out for lacking jurisdiction.

The court however, dismissed the application noting that that the issues relating to the violation of human rights which were raised in the petition are well within the High court’s jurisdiction.
